Copyright protects original forms of expression, including written content, software, photographs, music, video, illustrations, films, advertisements, databases, maps, and technical drawings.

It protects the expression of an idea rather than the underlying idea, method, system, or business concept. A concept may therefore remain unprotected while the code, text, image, or recording through which it is expressed qualifies for protection.


How does protection arise?

In most Berne Convention jurisdictions, copyright protection arises automatically when an eligible work is created. Registration, deposit, or payment of a fee is generally not required for the existence of the right. National registration systems may nevertheless provide evidential or procedural advantages.


What rights does copyright provide?

Depending on the jurisdiction and type of work, copyright may include rights relating to:

  • Reproduction

  • Distribution

  • Public performance

  • Communication to the public

  • Adaptation

  • Translation

  • Licensing

Moral rights may also protect the creator’s right to be identified and to object to certain unauthorised modifications.


Software and digital products

Computer programs can qualify for copyright protection. Protection may cover original source code, object code, documentation, and certain expressive elements, but not the general functionality, algorithmic idea, or business model in isolation.

Software products may require a layered strategy combining copyright, patents, trademarks, designs, trade secrets, database rights, and contractual restrictions.


Ownership and commissioned work

Payment for a creative project does not necessarily mean that all copyright has transferred to the customer. Ownership rules differ depending on the country, employment relationship, contractual terms, and type of work.

Agreements with employees, developers, freelancers, and agencies should clearly address ownership, assignments, licence scope, source files, third-party materials, open-source software, modification rights, and portfolio use.


Registration in the United States

Copyright arises automatically in the United States once an original work is fixed in a tangible medium. Registration can nevertheless be important for enforcement. Timely registration may provide access to statutory damages and legal costs and may create evidential advantages in litigation.
