A domain name is the unique internet address used to access a website. From a commercial perspective, however, it is more than a technical routing tool. When it corresponds to a company, brand, product, or service name, it can become one of the organisation’s most valuable digital assets.

Registering a domain name allows the registrant to use a specific address for a defined registration period. It does not automatically create trademark rights in the name. Likewise, owning a trademark does not automatically give the trademark owner control over every domain name containing the mark.


How do domain names work?

Domain names form part of the Domain Name System, which translates numerical IP addresses into human-readable names.

Domain names generally use:

  • Generic top-level domains such as .com, .net, and .org

  • Country-code top-level domains such as .tr, .de, and .uk

Registration, renewal, transfer, eligibility, and dispute rules can vary between extensions.


Domain names and trademarks

A trademark identifies the commercial origin of goods or services. A domain name primarily identifies an internet location.

The same sign can function as both a trademark and a domain name, but the rights arise through different legal and technical systems. Registering a domain before another party does not necessarily provide a defence where the domain targets or infringes an earlier trademark.

A naming clearance process should therefore cover trademark registers, company names, domain names, app stores, and social media platforms.


Domain name disputes

The bad-faith registration or use of a domain targeting another party’s trademark is commonly known as cybersquatting.

Under the UDRP, a complainant must establish that:

  1. The domain name is identical or confusingly similar to a trademark in which it has rights

  2. The registrant has no rights or legitimate interests in the domain

  3. The domain was registered and is being used in bad faith

A UDRP panel may order the transfer or cancellation of the domain name. It cannot award monetary compensation, and the procedure does not prevent either party from bringing the dispute before a competent court.


Managing a domain portfolio

A domain strategy should consider more than the primary .com address. Depending on the company’s markets and risk profile, the portfolio may include country-code domains, product names, common misspellings, campaign names, and strategically important variations.

Ownership records, renewal dates, registrar access, DNS settings, and security credentials should be centrally managed. Domains registered by employees, founders, agencies, or external developers should be formally transferred to the appropriate company entity.
